
Governor Beshear Rescinds Out-of-State Purchases

Governor Andy Beshear recently announced a significant change that directly impacts how patients access their medicine. Starting July 1, 2026, it will no longer be lawful for Kentucky patients to bring medical cannabis purchased from out of state into the Commonwealth.
This stems from Executive Order 2026-361, issued on June 11, 2026, which rescinds the earlier Executive Order 2022-798. That 2022 order provided conditional pardons, allowing qualifying patients to possess up to eight ounces of cannabis legally purchased in other states while Kentucky built its own regulated program.
Why This Change Now?
Governor Beshear has emphasized that this was always the intended transition. The out-of-state allowance served as a temporary bridge during the program’s early stages. Today, Kentucky’s medical cannabis industry has grown sufficiently with licensed cultivators, processors, and dispensaries like ours producing and supplying high-quality, tested products to meet patient demand fully.
As of mid-2026, more than 23,700 Kentuckians hold medical cannabis cards. The state has issued dozens of dispensary licenses, and local production ensures consistent availability. This shift prioritizes in-state, regulated products that undergo rigorous safety testing for pesticides, heavy metals, microbes, and potency, standards that provide greater peace of mind than unregulated out-of-state options.
Kentucky law now requires that all medical cannabis sold in the state be grown, processed, and tested here. This supports local jobs, strengthens the economy, and ensures compliance with strict quality controls that protect patient health.
What Does This Mean for You as a Patient?
Effective July 1, 2026: Possessing medical cannabis brought in from another state will no longer qualify for the previous conditional pardon. Purchases must occur at licensed Kentucky dispensaries with a valid Kentucky medical cannabis card.
No Impact on Cardholders: If you have a valid card, you can continue purchasing up to a 30-day supply (e.g., up to about 4 ounces of flower, depending on product type) without interruption.
Visiting Patients: Out-of-state cardholders can still obtain temporary Kentucky cards for limited purchases during visits.
Enforcement: Kentucky law enforcement will align with the state’s program. Buying locally keeps you fully compliant and supported.
